Joseph G. Kettell, ASA, Managing Director of the Paramus, NJ firm of Appraisal Economics, Inc., who will talk about “The State of the Solar Energy Industry in New Jersey.”

Mr. Kettell is an expert in the appraisal of power plants whose presentation on “The Appraisal of Renewable Energy Facilities and Solar Installations” drew acclaim at ASA’s 2011 International Appraisers Conference in Washington, DC. Joe will discuss supply & demand for photovoltaic solar facilities, government investment incentives, and the outlook for alternative energy sources. His talk is sure to be informative and timely. May Meeting: Valuing Historical Structures

The guest speaker is Joseph P. Novelli, ASA, owner of Midtown Contracting Corp. in New York City, who will talk about the "Unique Aspects of Valuing Historical Structures."

Mr. Novelli, who is certified as a General Real Estate Appraiser in both NY and NJ, is an ASA certified Machinery & Technical Specialties appraiser, specializing in cost surveys, who frequently serves as an expert witness. He has been a Senior Appraiser in the Construction Analysis Group at American Appraisal Associates and has also worked in the New York City area construction industry as a project manager and estimator. With a Fortune 500 roster of clients, he has evaluated many unique structures, including Harrah's Casino in Atlantic City, the Trump Tower in NYC, and Penn Station in Newark. Joe Novelli is a popular after-dinner speaker whose talks are "not to be missed."

March Meeting: Property Tax Grievances

The guest speaker is William H. Merdinger, ASA, President of the Long Valley, NJ firm of Dickinson & McCormick, Inc., who will talk about "Residential and Commercial Property Tax Grievances."

Mr. Merdinger, who took his B.S. at Rutgers, has been active in real estate appraising since 1970. A Certified Tax Assessor, he has served as Assessor for several New Jersey Townships, including Belleville, Glen Ridge and Mansfield, and has consulted for or been an expert witness for others. His published and delivered papers include "Equalization in the Federal Courts," "Tax Abatements," "Business Enterprise Zones," and the "Newark Revaluation Impact." Mr. Merdinger has also taught real estate fundamentals and specific valuation subjects for Rutgers, the NJ State Association of Assessors and elsewhere.

The guest speaker is G. Scott Clemons, Chief Investment Strategist for Brown Brothers Harriman’s Wealth Management Business, who will talk about the 2011 Economic and Investment Outlook for business, real estate and other investments.

Mr. Clemons, who received his BA in Classics magna cum laude from Princeton University, joined Brown Brothers Harriman in 1990. He has held a variety of roles within BBH's investment management business, including as an analyst and portfolio manager of European and Asian equities, based both in New York and London, and as a lead manager of domestic equity management. A Chartered Financial Analyst, and a member of the New York Society of Security Analysts and the CFA Institute, he is the firm's primary writer and speaker on topics related to the financial markets and wealth management. Mr. Clemons sits on the advisory boards of the Morgan Library and Museum, the Princeton University Library, the Grolier Club, and the Getty Research Institute. He is also a director of the Research Corporation, America's oldest foundation dedicated to the advancement of science.

The Philadelphia Chapter of the American Society of Appraisers (ASA) will hold its annual Business Valuation Seminar at the Doubletree Guest Suites Hotel in Plymouth Meeting, PA on Friday, April 29, 2011. The program includes sessions focused on limited partnership valuation, private cost of capital, financial fraud and its impact on business appraisal, recent important court decisions affecting business appraisal, and a panel discussion of matrimonial law appraisal.

James R. Park, ASA, a partner in the San Antonio, TX firm of Munroe, Park & Johnson, Inc., will discuss "Valuing Limited Partnerships" from 8:30 to 9:30 am, exploring both income and market approaches. He will also talk about recent litigation of family limited partnerships, including his own experiences. Mr. Park was graduated from Texas A&M University with a BBA in Finance and contributed to the Comprehensive Guide for the Valuation of Family Limited Partnerships and other publications. Robert T. Slee, President of the Charlotte, NC firm of Robertson & Foley, will talk about "The Private Cost of Capital," a discount rate model that measures private company risk. He will talk from 9:30 am to 12:15 pm, with a 15-minute break at 10:45 am. Mr. Slee, who has an MA from the University of Chicago and an MBA from Case Western Reserve University, founded MidasNation, a community dedicated to helping owners increase the value of their businesses. He is the author of over 200 journal articles and several books, the most recent of which is Midas Marketing: How Midas Managers Make Markets.

David Duffus, a Partner in ParenteBeard's Forensic, Litigation and Valuation Services group, will talk from 1:15 to 2:30 pm about "Financial Statement Fraud, including recent statistics, typical schemes, and the impact on business valuation. A Certified Public Accountant with an MBA in Accounting and Finance from the University of Pittsburgh, he specializes in complex litigation services, forensic accounting and valuation services assignments. Mr. Duffus, who joined ParenteBeard from PricewaterhouseCoopers, is a frequent speaker on fraud and its economic damages.

John Barton, ASA, President of the Lyndell, PA firm of Brandywine Valuation Consultants, LLC., will review "Recent Valuation Cases," primarily US Tax Court and Court of Appeals decisions in estate, gift tax and equitable distribution cases in PA and NJ from 2:30 – 3:25 pm. Mr. Barton holds an MBA from LaSalle in Finance and Accounting, and is a specialist in the analysis of closely-held stock, preferred stock, intangible assets, and debt securities. He has taught business valuation courses for ASA, Big Four accounting firms, the IRS, and at Villanova University, and has appeared as an expert witness in PA, NJ, and FL courts and in US Federal District Court.

Gary Friedlander, Esq., ASA, will lead a panel discussion from 3:40 to 4:40 pm on "Matrimonial Law Appraisal Practice." Mr. Friedlander's Norristown, PA practice concentrates on family law and the valuation of closely held corporations and professional practices. He holds an MBA from Drexel University and took his JD from the Villanova University School of Law. He is a member of the Pennsylvania and Montgomery County Bar Associations and is a participant in their family law sections.

March: 7-Hour National USPAP Update Course

The Philadelphia Chapter of the American Society of Appraisers will sponsor an all-discipline National USPAP 2010-2011 7-hour Update Course on Wednesday, March 23, 2011 from 9:00 am to 5:00 pm. The course will be held at the Marriott SpringHill Suites, 430 Plymouth Rd, Plymouth Meeting, PA 19462 (Phone: 610-940-0400), which provides ASA members and those taking the USPAP class with discounted rates as low as $139/night if reserved by 2/28/11. The National USPAP Update Course is a one-day course that focuses on recent changes to USPAP requirements for ethical behavior and competent performance by appraisers. This course, which clarifies several commonly misunderstood aspects of USPAP, will aid appraisers in all areas of appraisal practice seeking updated USPAP competency, including those subject to state licensing or certification and continuing education requirements imposed by professional organizations, client groups, or employers.

The cost of the 1-day course is $125 per person if paid by check, $129 if paid online, and includes a student manual, coffee breaks and snacks.

Alan Fausel is Vice President and Director of Fine Arts at Bonhams, a privately owned British auction house. Distinguished as a scholar, curator, and appraiser, he holds a bachelor's degree in art history from UCLA, a master's degree and doctoral study at Stanford University. Mr. Fausel served on the appraisal staff of Butterfield's Auction in San Francisco and Doyle New York. He was on the curatorial staff of the Fine Arts Museum of San Francisco and the Frick Art Museum in Pittsburgh. At Bonhams, Mr. Fausel conducts regular sales of American, European and Old Master paintings. He also manages the famous Dogs in Show & Field Sale in New York City. Mr. Fausel teaches at New York University's Graduate School of Arts Education and is a paintings appraiser on PBS's Antiques Roadshow since the series began in 1997.

Mr. Dragon took his B.A. at Lehigh University and earned two masters’s, an M.S. in Financial Economics from the University of London, and an M.B.A. from the Kellogg School of Management at Northwestern University. He has over 20 years experience in financial analysis, business valuation, merger and acquisition and litigation support. Ray is accountingWEB.com’s official blogger on Business Valuation. His talk will explain why a reasonable compensation analysis shows that “soak the rich” really means “heavily tax the returns on the investment capital of small business owners”.

Mr. Russell earned his JD degree at Syracuse University, and was most recently a lobbyist for NATOA (National Association of Telecommunication Officers and Advisors). As Director of Government Relations for ASA, he works on legislative initiatives beneficial to ASA, and is staff liaison to ASA-PAC. He also coordinates with ASA’s Governmental Relations Committee, and keeps members informed of legislative and regulatory issues.

Mr. Ibex, who got earned his B.A. and M.B.A. in Accounting at Pennsylvania State University, has more than 35 years experience in financial and business operations. As a member of Marcum LLP's Public Trust group, he has provided forensic and advisory services to government and quasi-government agencies. As head of Marcum's Commercial Litigation Support Department, he provides business valuation, damage quantification, forensic investigations, accounting, advisory and consulting services in matrimonial, corporate, business and government matters. Mr. Ibex has also served on his local Board of Education for over 25 years, served on his town Council, and been appointed to Oceanport New Jersey's Planning Board by its Mayor.

Business Valuation Seminar: April 2010

The Philadelphia Chapter of the American Society of Appraisers (ASA) will hold its annual Business Valuation Seminar at the Doubletree Guest Suites Hotel in Plymouth Meeting, PA on Friday, April 30, 2010. The program includes how-to sessions conducted by leading thinkers on such topics as IRC 409A and SFAS 123R, intellectual property valuation, reasonable compensation, and lack of marketability discounting.

Mark L. Zyla, ASA, a Managing Director of the Atlanta Georgia firm of Acuitas, Inc. will present A Case Study in 409a and 123R Valuations from 8:30-10:30 am. Mr. Zyla is the author of Fair Value Measurements: Practical Guidance and Implementation (Wiley, 2009) and co-author of AICPA courses Fair Value Accounting: A Critical New Skill for All CPAs and Accounting for Goodwill and Intangible Assets. His presentation will explore current valuation methods, option pricing models and probability return models, discounting for lack of control and lack of marketability, and compare IRS 409A vs. auditor's SFAS 123R expectations.

P.J. Pankaj Patel, ASA, a Senior Vice President, and Edward P. Hamilton, a Vice President, at the Princeton, NJ Valuation Research Corp. will discuss Valuing Intellectual Property And Other Intangible Assets For Financial Reporting Purposes In A Business Combination from 10:15-11:30 am. Mr. Patel who took his B.S. at the University of Toronto and M.B.A. at Canisius College specializes in the valuation of intangible assets including in-process R & D, software, trademarks, patents and copyrights. Mr. Hamilton, whose baccalaureate is from Rowan University in physics, holds an M.B.A. from Temple University. He focuses on the valuation of intellectual property and intangible assets such as trademarks, technology, software, customer relationships and in-process R&D. Using valuation case studies in consumer products, software, technology, and defense companies, Messrs. Patel and Hamilton will discuss valuing brands, customer relationships and technology, including use of the relief from royalty and excess earnings methods and the 25%/33% rule in valuing intellectual property.

Jim Bowers, a Vice President, and Jeff Bacher, a Senior Consultant, at the Philadelphia office of the Hay Group, will present a program on Reasonable Compensation from 11:30 am to 12:15 pm. Mr. Bowers, who took his B.S. at Pennsylvania State University and holds a M.I.L.R. from Cornell, specializes in executive compensation, global job evaluation and general rewards, with a focus on the chemical, pharmaceutical, and energy industries. Mr. Bacher is a Senior Executive Compensation Consultant for Hay and has over twenty years consulting and executive experience. Their presentation will focus on the nuts and bolts of reasonable compensation, including tools to determine reasonableness, and factors that would undermine the presumption of reasonableness.

John J. Barton, ASA, President of Brandywine Valuation Consultants, LLC in Lyndell, PA will discuss Techniques for Estimating the Discount for Lack of Marketability from 1:15-4:40 pm. Mr. Barton holds a B.A. from LaSalle University, an M.A. in literature from Fordham University and an M.B.A. from LaSalle in Finance and Accounting. A specialist in the analysis of closely-held stock, preferred stock, intangible assets, and debt securities, he has taught business valuation courses for ASA, the Big Four accounting firms, the IRS, and at Villanova University. As part of a listening tour in preparation for the upcoming National Governors Conference, Mr. Griffith urges members to come to the Town Hall Meeting and be heard. He is looking for comments, suggestions, and opinions on ASA in particular, and the appraisal profession in general. This is an opportunity for appraisers in all disciplines to speak out on topics of their choosing.

Tim Griffith is the President of Griffith Appraisals in Secaucus, NJ and is a licensed real estate appraiser in New Jersey, New York and Pennsylvania. A past President of the ASA Northern New Jersey Chapter, he has also served on the Board of Directors of the Appraisal Institute's Northeast New Jersey Chapter. A co-author of The Real Estate Appraisal Exam, he is one of a small number of appraisers in the area accredited by the Appraisal Foundation as an AQB Certified USPAP Instructor.

ASA Philadelphia January Meeting: The State of ASA

The Philadelphia Chapter of the American Society of Appraisers will host a Breakfast Meeting on Wednesday, January 20, 2010 at the Doubletree Guest Suites in Plymouth Meeting, PA at at 8:00 am. The guest speaker will be ASA Region 1 Governor, Timothy A. Griffith, ASA, who will explore The State of ASA in what he characterizes as “listening visit” – an opportunity to answer questions and gather information.

Timothy A. Griffith is a commercial real estate appraiser, preparing real property appraisals for major lending instructions, non-profit organizations, corporations, attorneys, private individuals, and estates. He holds a State Certified General Real Estate Appraisal License in the states of New Jersey, New York, and the Commonwealth of Pennsylvania. He holds a Masters of Science in Real Estate Valuation Analysis from New York University and has taken professional development courses offered by the Appraisal Institute, the International Association of Assessing Officers, and the American Society of Appraisers.

Spring 2009: 15-hr USPAP 2010-2011 Course

The ASA Northern New Jersey Chapter together with the ASA Hudson Valley Chapter will host a joint meeting and tour at the West Point Military Academy, starting at the Academy Library, 758 Cullum Rd, West Point, NY (view map) on Wednesday, October 14, 2009 at 3:30 pm.

Alan Conrad Aimone, ASA, the West Point Librarian, will conduct a tour of the historic buildings and statues on the Academy’s campus, culminating in dinner at the Thayer Hotel, the luxury landmark overlooking the Hudson River. The Northern New Jersey Chapter of the American Society of Appraisers and the New Jersey North Chapter of the National Association of Independent Fee Appraisers will jointly sponsor a two-hour Real Property Seminar on The Home Valuation Code of Conduct and Fannie Mae Form 1004 MC. The seminar will be held on Monday, March 23, 2009 from 4:00-6:00 pm at the Wilshire Grand Hotel, 350 Pleasant Valley Way, West Orange, NJ 07052. Robert J. Luciani, ASA, IFA, a real property appraiser practicing in Philadelphia, will conduct the seminar, which will be followed by a Chapter Dinner Meeting.

The housing bubble and subsequent melt-down has led to two new requirements for appraisals submitted to the federal mortgage agencies.

The new Home Valuation Code of Conduct (HVCC), effective May 1, 2009, applies whenever the primary lender plans to sell the loan to Fannie Mae or Freddie Mac. It's designed to prevent conflicts of interest.
Beginning April 1, 2009, appraisal reports submitted to Fannie Mae will require Form 1004 MC, a Market Conditions Addendum. Its purpose is to illuminate neighborhood market trends and conditions.

Mr. Luciani will explore the HVCC and 1004 MC requirements and relate them to current USPAP obligations for appraisers.

Multidisciplinary Appraisal Lecture and Tour

The Northern NJ ASA Chapter and the Royal Institute of Chartered Surveyors (RICS) will jointly sponsor a Multidisplinary Appraisal Lecture and Tour on Thursday, May 15, 2008 at the historic Grand Lodge building, Masonic Hall, 71 W 23rd St, New York, NY 10010-4149. Charles Rosoff is the President of Appraisal Services Associates of New York and Connecticut, and is a former ASA NY State Director, and a past President of the NYC Chapter. ASA-accredited in Fine Arts, his practice focuses on forensic valuations for dispute resolution and litigation. Charles got his B.A. in Art History from the University of Michigan, did postgraduate work at Sotheby's London, NYU, and Cooper-Hewitt, and taught Research Methods for Appraisers at NYU. He currently teaches the ASA PP204, Personal Property Valuation - The Legal and Commercial Environment at Northwestern University, the University of Georgia and Pratt. A frequent contributor to the ASA Personal Property Journal on legal issues, and admitted for expert testimony in several states, he has participated in seminars at the Association of the Bar of the City of New York and created courses for ALI-ABA, the continuing education project of the American Law Institute & the American Bar Association. Bob Connelly, who operates an antiques, auctions and appraisals business with his wife Sallie, has performed appraisals for the Cooperstown Baseball Hall of Fame, the Basketball Hall of Fame, and other sports museums. He has testified many times on the valuation of sports memorabilia and celebrity items. Some of his more interesting appraisal assignments include the original Heisman trophy, the oldest known soccer ball in the world, and Liberace's costumes. Rebecca Posoli-Cilli graduated from Embry-Riddle Aeronautical University with a degree in Business Administration. After heading the Research Department of another large aircraft brokerage, she joined Avjet as Vice President of Sales & Acquisitions in 1997. Paula Konikoff is an independent real estate appraiser and consultant whose practice focuses on the valuation of commercial, industrial and mixed use properties for litigation, arbitration and due diligence. An Urban Land Institute advisor, she is also Vice Chair of the Appraisal Standards Board (ASB) of the Appraisal Foundation.
